Official Competition Rules - Trumpet

1. Introduction

These are the Official Competition Rules governing the Ictus International Music Competition (the “Competition”) presented by Ictus Music, Inc., 4627 Mansion Street, Philadelphia, PA 19127 (“Ictus”). The Competition is a new and innovative online contest wherein musical ensembles and soloists are judged based on online video submissions. Participants in the Competition are eligible to receive prize money, written feedback from experienced judges, and opportunities to be interviewed by Ictus. Additionally, Ictus may post participants’ video submissions online and via social media in order to share them with as broad an audience as possible. The ultimate purpose of the Competition is to provide participants with opportunities to be heard and to increase the profile and perception of music education and classical music generally. 

By making a submission to the Competition, you agree to comply with all of the terms and conditions stated in these Official Competition Rules, as well as with any terms proffered by third-party submission platform Acceptd. 

2. Eligibility

The 2020 competition will be open to trumpet soloists in the following categories:

1.  Ages 13 and under

2.  Ages 14 through 18

3.  Ages 19 through 25

4.  Ages 26 and up

Age is based on applicant’s age on July 15, 2020 – ICTUS may request documents to verify an applicant’s age if it is deemed necessary.

THE CONTEST AND ANY PERTINENT TERMS OF THESE OFFICIAL COMPETITION RULES ARE VOID WHERE PROHIBITED. 

3. Repertoire

Trumpet applicants may submit a video tape no more than the time limit per category listed below. Time can be allocated between one or more compositions, or one or more movements within a composition.

1.  Ages 13 and under (8 Minutes)

2.  Ages 14 through 18 (10 Minutes)

3.  Ages 19 through 25 (12 Minutes)

4.  Ages 26 and up (15 Minutes)

The repertoire selection is open to the applicant and all judging is done through video submission. The following rules/restrictions apply.

a.)   The applicant can submit any published piece, combination of pieces, or combination of movements of pieces as long as the total combined time is within the maximum time limits listed above. The applicant may make cuts to pieces to fit the time limits if he/she wishes.

b.)   The applicant must perform with an accompaniment unless the piece is written for solo/unaccompanied trumpet. The competition will accept video tapes with piano, orchestra, chamber ensemble, wind band, percussion, guitar, electronics or any other accompaniment required by the composer in the published piece.

c.) ** COVID-19 exception ** The competition will accept recordings with a pre-recorded accompaniment for those applicants who are not able to record with a live accompanist because of social distancing.

c.)   The video must have been recorded between June 15, 2019 and July 15, 2020.

d.)   Each piece must be performed in one take with no edits. If an applicant chooses to submit multiple pieces, they must be submitted together as one video file that does not exceed the maximum time-limits for the applicant’s age category. Ictus reserves the right to immediately disqualify any applicants whose tapes show editing within one piece.

e.)   The video must be from only one angle that shows the trumpet and the accompaniment (if the piece requires accompaniment). No multi-angle videos/montages will be accepted as they suggest that the audio and video may have be edited.

f.)    The applicant does not have to submit a score at the time of application. However, if requested by the committee, the applicant must submit either an original score or a copy of the score with written permission for competition use from the publisher. Failure to respond to this request will result in the applicant being disqualified.

g.)   There is no live round – all adjudication will take place online through video submission. It is suggested that the applicant submit as high quality of video as possible to give a fair representation of their playing. Please note that applicants have won prizes in past years through submitting tapes that were recorded on their mobile device. 


4. Contest Term

You must submit a high-quality video of your performance (a "Submission") that complies with the requirements of these Official Competition Rules not later than July 15, 2020 at 11:59 p.m. Eastern Daylight Time (the "Submission Deadline") using the means described in these Official Competition Rules. Submissions will be judged after the Submission Deadline, with finalists selected and notified by August 15, 2020. Winners will be notified on September 15, 2020 and prize money will be dispersed no later than October 31, 2020.

Note: Submissions must have been recorded between June 15, 2019, and July 15, 2020. 

5. How to Enter

All applications will be submitted entirely through Acceptd, the exclusive third-party submission platform used by Ictus for the Competition. Please access Acceptd via this link: https://app.getacceptd.com/ictus. There, applicants must upload one or more video files of their musical performance(s). Acceptable file types include MP4, MPEG, MPG, MOV, AVI, WMV, M4V, FLV, WEBM, MKV, and M2V. By making a Submission, you agree to be bound by these Official Competition Rules, and Acceptd’s terms and conditions. 

By making your Submission, you assign all rights in any submitted video to Ictus, including the grant to Ictus of permission to publicly display the Submission on its website, on YouTube, or on any other media platform, as discussed in Paragraph 8 below. 

Those applicants under age 18 must have their parents electronically sign an addendum via e-mail that grants all rights in any submitted video to Ictus, including the grant to Ictus of permission to publicly display the Submission on its website, on YouTube, or on any other media platform, as discussed in Paragraph 8 below. Any application without this electronically signed addendum will be considered incomplete.

Entrants must also provide the following materials to Ictus for the use of the judges only if requested by an administrator from Ictus.

An original copy of the score of the musical work(s) included in the Submission,

OR

A photocopy of the score, along with written permission from the publisher of that work authorizing copies to be made for the use of Ictus in connection with the Competition.

Once you have made a Submission, materials will not be returned. Submissions may be disqualified at any time for non-compliance with these Official Competition Rules. Ictus will make the final determination as to which Submissions are eligible to take part in this Competition and will be considered for a prize or award. 

ANY ATTEMPT TO ENTER THE COMPETITION EXCEPT THROUGH ACCEPTD, AS PROVIDED ABOVE, IS VOID. 

6. Application Fee

Each applicant must pay an entrance fee of $125. This fee is non-refundable, and no circumstance—including an applicant’s disqualification from the Competition—will result in a refund of any kind. No Submissions will be accepted after July 15, 2020. 

THE ENTRY FEE IS NOT REFUNDABLE, AND NO CIRCUMSTANCE ‒ INCLUDING AN ENTRANT’S DISQUALIFICATION ‒ WILL RESULT IN A REFUND. 

7. Grant of License

By making your Submission, you assign all rights in any submitted video to Ictus, including granting Ictus permission to publicly display the Submission on its website, on YouTube, or on any other media platform. 

Those applicants under age 18 will have their parents electronically sign through Acceptd granting Ictus these rights.

Specifically, your Submission grants Ictus an irrevocable, paid-up, non-exclusive, perpetual, worldwide license to use, publicly perform, display, reproduce, transmit, sublicense, and distribute in all media formats now known or hereafter created the Submission in connection with (1) the Competition and the promotion of the Competition; (2) the promotion of future iterations of the Competition; and (3) the promotion of Ictus in general (collectively, the "License"). The License will commence on the date you make your Submission. 

By making your Submission, you represent and warrant that you have the right to grant the licenses addressed in these Official Competition Rules. 

8. Indemnification

You will indemnify, defend, and hold Ictus harmless from and against any losses (including reasonable attorneys’ fees) associated with any third-party action (a) arising out of your breach of any representation, warranty, or provision addressed in these Official Competition Rules; or (b) asserting or arising out of any claim that your Submission infringes or violates any law, regulation, or third-party right, including any intellectual property right. 

9. Prizes

Each “Category Winner” will be awarded a “Category Prize.” Only Category Winners are eligible to receive a cash prize and the opportunity to be interviewed by Ictus. Cash prizes are made at the discretion of the judges. Ictus reserves the right to split any cash prize in the event of a tie in any Category. All decisions by Ictus and its judges are binding and final. 

No prize transfer, assignment, or substitution by any Category Winner is permitted. TAXES ARE THE SOLE RESPONSIBILITY OF THE WINNERS. All Category Winners will be required to provide Ictus with a completed IRS Form W-9 before receiving any payment. 

10. Additional Releases

By making a Submission to the Competition, you represent and warrant to Ictus that you are recording this work for the educational purpose of competition/written feedback from Ictus Music’s judges and release all rights to your performance to Ictus. Those applicants under age 18 must have their parent or guardian sign an addendum agreeing to these entire official contest rules. This will be done electronically through Acceptd.

Additionally, Ictus may require each Winner or their parent/legal guardian to complete, execute, and return an Affidavit of Eligibility, a Liability Release, and, where lawful, a Publicity Release, as well as certain other documentation reasonably requested by Ictus. Failure to respond to Ictus in a timely manner or failure to return documents in a timely manner may result in disqualification and selection of an alternate winner in the applicable Category(s). 

Each Category Winner agrees to grant to Ictus and those acting pursuant to its direction or control, the right to print, publish, broadcast and use, worldwide in all media formats now known or hereafter created, at any time or times, the Winner’s name, portrait, picture, voice, likeness and biographical information as news or information and for advertising, trade and promotional purposes without additional consideration, and without notification, review, or approval. 

By accepting any prize or award, each Category Winner agrees that any Affidavit and/or Releases, and any grant of permission to use his or her name, portrait, picture, voice, likeness and biographical information, as stated above, may be secured by Ictus electronically, for example but not limited to, by email or by facsimile, and such secured Affidavit and/or Releases and permission will have the same force and effect as if any of them had been secured in a written document which was executed by such person. 

Further, by accepting any prize or award, each Winner releases and agrees to hold Ictus harmless from any and all liability for any injuries, loss, or damage of any kind to persons and/or property, arising in whole or in part, directly or indirectly, from acceptance, possession, use or misuse of a prize, participation in any Competition-related activity, or participation in this Competition. 

11. Limitation on Liability

Ictus assumes no responsibility for any error, omission, interruption, deletion, defect, delay, theft or destruction or unauthorized access to, or alteration of Submissions and other materials transmitted to Ictus in connection with the Competition. Ictus is not responsible for any problems or technical malfunction of any telephone network or telephone lines, computer or Internet systems, servers, or providers, computer equipment, software, failure of any e-mail or Submission to be received by Ictus on account of technical problems, human error, traffic congestion on the Internet, or any combination thereof. 

Ictus is not responsible for any incorrect or inaccurate capture of information or the failure to capture such information, whether caused by the actions of third parties or by any of the equipment or programming associated or used in connection with the Competition and assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to the Ictus website. Ictus is not responsible for injury or damage to any person’s computer arising from or relating to participation in this Competition or viewing or downloading materials from the Ictus website. 

IN NO EVENT WILL ICTUS OR ITS AFFILIATES OR RELATED COMPANIES, OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS, BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, ARISING OUT OF YOUR PARTICIPATION IN THIS CONTEST, ACCESS TO AND USE OF THE ICTUS WEBSITE, THE ACCEPTD WEBSITE, OR YOUR PARTICIPATION IN THE COMPETITION. ICTUS MAKES NO WARRANTIES WITH RESPECT TO THE CONTENT OR FUNCTIONALITY OF THE ACCEPTD WEBSITE, AND YOU AGREE TO HOLD ICTUS HARMLESS FROM ANY LIABILITY ARISING THEREFROM. WITHOUT LIMITING THE FOREGOING, EVERYTHING ON THE ICTUS WEBSITE, INCLUDING THE COMPETITION, IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES SO SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. CHECK YOUR LOCAL LAWS FOR ANY RESTRICTIONS OR LIMITATIONS REGARDING THESE LIMITATIONS OR EXCLUSIONS. 

12. Dispute Resolution

Ictus’s decisions on all matters relating to this Competition are final and binding in all respects. These Official Competition Rules, transactions occurring under them, and the relationships created by them, will be construed and interpreted in accordance with the laws of the Commonwealth of Pennsylvania, without regard to its conflict of laws principles. You agree that any and all disputes that cannot be resolved between you and Ictus, claims and causes of action arising out of or connected with this Competition, or any prizes awarded, or the determination of the Winners will be resolved individually, without resort to any form of class action, exclusively by a state or federal court located in Pennsylvania. You and Ictus agree to submit to the personal jurisdiction of the courts located within Philadelphia County, Pennsylvania for the purpose of litigating all such claims or disputes. All parties waive any objection to the laying of venue for any suit, action, or proceeding in such courts. The substantially prevailing party in any action will be entitled to recover its costs and attorneys’ fees. 

13. Entire Agreement

These Official Competition Rules set forth the entire understanding between you and Ictus regarding the Competition and may not be modified except in a writing signed by an authorized representative of Ictus. 

14. Winners List/Official Competition Rules Requests

To request the names of each Winner or to request a hard copy of these Official Competition Rules, mail a self-addressed stamped envelope indicating either “Ictus International Music Competition Winners List” or “Ictus International Music Competition Rules Request” for receipt by December 1, 2020, to Ictus Music, Inc., 4627 Mansion Street,  Philadelphia, PA 19127. 

BY MAKING A SUBMISSION TO THIS COMPETITION, YOU (1) ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTAND THE FOREGOING RULES, TERMS, AND CONDITIONS, AND (2) AGREE TO BE BOUND THEREBY.
